Small Business Tax
Did you know?
If you qualify as a Small Business Corporation then the first R95,750 profit is tax free and then profit between R95,751 and R365,000 pays 7% Income Tax instead of the 27% applicable to normal businesses.
Profit between R365,001 and R550,000 pay 21%. So only from R550,001 upwards do you start paying the usual 27% Income Tax.
To qualify for Small Business Tax -
all shareholders or members must be natural persons
shareholders required to solely be invested in your business (may not hold shares in other private companies)
Total Gross Income should not exceed R20 million for the tax year
Investment Income should not exceed 20% of gross income

INCOME TAX VS PROVISIONAL TAX


Sometimes there is confusion around which taxes apply to whom. Let us try to clear up the difference between income tax and provisional tax and how they are applied and to whom.

INCOME TAX:

Is a payment imposed on individuals and companies - by our government. This tax is based on the amount of income less allowable deductions for individuals (or allowable expenditure of a company) as prescribed by SARS within a financial year.

For the individual, an assessment year is the period from 1 March to the 28 February each year. 

For a company it refers to the financial year that the company stipulated in their MOI (Memorandum on Incorporation).

PROVISIONAL TAX:

Is a system of paying the income tax due for the following financial period in instalments, based on your calculated projection of income.
Did you know? Individuals that are in high tax brackets, independent consultants, and companies with high profit margins benefit from being provisional tax payers as they make affordable payments at specified intervals during the year instead of being burdened with an astronomical liability at the end of the financial period.

Admin Penalties is a penalty levied under Section 210 of the Tax Administration Act (TAA). The Act prescribes the various types of non-compliance which are subject to fixed administrative penalties. The penalty is imposed only for non-submissions of tax returns in respect of individuals and companies.
Taxpayers who do not submit their tax returns will be charged an admin penalty which must be paid over to SARS.

SARS NEW PENALTY RULE - released 8 November 2021
New Penalty Rule and Auto-Assessment process: With effect from 1 December 2021, SARS has been empowered to levy a late submission of return penalty where one or more personal income tax returns are outstanding. As a transitional measure for the first year, the one tax return or more rule will only apply to the 2021 tax return.
The deadline for individual non-provisional taxpayers is 23 November 2021. Taxpayers in the auto-assessment population, who neither accepted nor edited and submitted their simulated assessments by this date, will receive an original assessment based on an estimate in accordance with section 95 of the Tax Administration Act, 2011. This assessment is not subject to objection and appeal. However, a taxpayer who is not in agreement with his or her assessment may file a complete and accurate tax return within 40 business days of the assessment date. Such a return will be late, which means that normal late submission penalties and interest (where applicable) will apply. See the letter to stakeholders for more information.

1. Don’t Leave it Last Minute: Keep dates and deadlines in mind while creating reminders so you’re not doing the books the night before. Do it earlier to avoid mistakes and spend less time looking for crucial information.
2. Keep Records Nice and Tidy: Cluttered records with endless bits of paper will make it a nightmare to do the books with valuable information all over the place. Keep them organised so you know exactly what to look for without wasting time.
3. Store Your Receipts: If you store receipts through software, it means you’ll finally get that paperless office you’ve wanted. Everything is in one place and if there’s ever an investigation, all of the information related to expenses will be available within your software or app via attachments. So, you’ll always be compliant.
4. Keep Business and Personal Finances Separate: To help you do the books much faster, think about keeping your business and personal finances separate. So, you won’t need to look through personal information for business related finances and vice versa.
